(3.) In the impugned order being Order dated 26th August, 2013 in Misc. Appeal No. 106 of 2011, the learned Court below while rejecting the Misc. Appeal No. 106/2011 affirmed the order of the learned Trial Court in Misc. Case No. 4 of 2005 passed by the learned Civil Judge (Junior Division), 3rd Court, Sealdah in Title Suit No. 38 of l987.;
