Indira Banerjee, J. - (1.) In this writ application, the petitioner has inter alia challenged an order of the District Inspector of Schools, (SE), Murshidabad being Memo No. 1387/1(1)-G dated 18th March, 2004 rejecting the prayer of the petitioner, an Assistant Teacher of Sargachi Ramkrishna Mission High School, Sargachi, Murshidabad District, hereinafter referred to as the school for the higher post graduate scale of pay.
(2.) The petitioner graduated with Honours in Geography in the 1996 securing the 1st Class. In 2000 the petitioner obtained Master of Science degree in Geography from the University of Calcutta securing 1st Class marks. The petitioner thereafter passed Bachelor of Education examination from Calcutta University in the year 2001 and was placed in the 1st Class.

In view of retirement of one Sri Pradut Kr Saha, Assistant Teacher of the school with effect from 30th September, 2000 the respondent District Inspector of Schools by a Memo No. 02-G dated 15th September, 2000 granted permission to the school to fill up the post of Assistant Teacher of Geography from the general category. The requisite qualifications for the post as fixed by the respondent District Inspector of Schools was B.A., B.Sc. (Hons.) preferably trained.;
