JUDGEMENT
JAYANTA KUMAR BISWAS, J. -
(1.) THE twelve petitioners in the WPST under Article 226 of the Constitution of India dated November 25, 2014 are questioning an order of the West Bengal Administrative Tribunal dated October 31, 2014 refusing them interim relief in their pending OA No.990 of 2014.
(2.) THE interim relief the petitioners sought before the Tribunal was the following:
"(a). An interim order and also ad -interim order directing the respondents not to give effect of the Memo. Being No. HNG/6S -48 -79/Pt -VI/696 dated 09.07.2014 as issued by the Deputy Director of Health Services (Nursing branch), Govt. of West Bengal ("P -13") until disposal of this writ petition and also allow Trainee Reserve facilities to the petitioners for the Post basic (Ng) courses for the session 2013 -2015 with immediate effect."
(3.) THE thing dated July 9, 2014 referred to in the interim relief prayer was actually a notice dated July 9, 2014 issued by the Dy Director of Health Services (Nursing), West Bengal. It was given inviting applications in prescribed form from candidates eligible to receive Trainee Reserved Sponsorship Certificate for the session 2014 -16 in Post Basic B.Sc. Nursing course and M.Sc. Nursing course.
The petitioners approached the Tribunal with the case that they were entitled to receive Trainee Reserved Facilities course in the post Basic B.Sc. Nursing category for the session 2013 -15. They prayed for an order restraining the respondents in the OA from giving effect to the notice dated July 9, 2014 and an order directing the authority to allow them the facility in question.;
