JUDGEMENT
NISHITA MHATRE,J. -
(1.) The petitioner is aggrieved by the order passed by the West Bengal State Administrative Tribunal in O.A. No. 761 of 2010. The Tribunal has confirmed the order passed by the respondents dismissing the petitioner from service.
(2.) The petitioner was charge sheeted for defalcation of a certain amount. The charge sheet mentioned that he had submitted a false travelling allowance bill along with five other employees and misappropriated an amount of Rs. 1770/-. An enquiry was instituted against him where the petitioner denied his signature on the acquittance Roll indicating that he had been paid the amount.
(3.) The Enquiry Officer has held that the petitioner was guilty of the misconduct alleged against him. By the final order issued by the Police Authorities, it was held that the petitioner should be dismissed from service having been found guilty of the charges levelled against him. However, neither the Enquiry Officer nor the Disciplinary Authority has dealt with the issue as to whether the petitioner's contention that his signature was not appended on the acquittance Roll, was correct.;
