JUDGEMENT

Arun Kumar Mitra, J. - (1.) In this Writ Petition the petitioner No. 1 is the Jute Corporation of India of Employees' Union espousing the cause of petitioner Nos. 2 & 3. The case as has been made out in the Writ Petition is that one Bidyut Dutta who was an employee (Senior Inspector) of Jute Corporation of India died in harness on 30.9.1991 and one Prasenjit Bhaduri was the watchman-cum-peon under Jute Corporation of India who died in harness on 29.1.1993. The petitioner No. 2 Sm. Sadhana Dutta is the mother of late Bidyut Dutta and petitioner No. 3 Sm. Shrila Bhaduri (Nee Singha Roy) is the widow of late Prasenjit Bhaduri.

Consequent on the death of the son the petitioner No. 2 submitted representation before the authorities of Jute Corporation of India on 14th October, 1991 praying for appointment of her youngest daughter Smt. Seuli Dutta on compassionate ground but nothing was done by the respondent. The petitioner No. 2 finding no option made representation before Sri Pranab Mukherjee, the then Deputy Chairman of the Planning Commission of India and prayed for interference and favourable action for getting appointment of her youngest daughter Sm. Seuli Dutta as dependent of pre-deceased son Bidyut Dutta. After receiving the representation Sri Mukherjee requested Mr. Ashok Gehlot, the then Minister of State for Textile to examine the proposal for taking just and proper action with regard to petitioners prayer for appointment of her daughter on compassionate ground. In reply the Minister of State for Textile informed the Deputy Chairman, Planning Commission through letter dated 15.9.1992 that as Jute Corporation of India is facing problem and is considering implementation of voluntary retirement scheme new appointments including appointments of compassionate ground and are not being made for a considerable period.

In a similar manner the petitioner No. 3 made an application on 15.2.1993 before the Chairman-cum-Managing Director of Jute Corporation of India requesting him to give an appointment to her to a post commensurate with her qualification on compassionate ground as she was dependent of the teased employee Prasenjit Bhaduri.;
