JUDGEMENT

ASHIM KUMAR BANERJEE,J. - (1.) In re.: C.A.N. 2695 of 2011. The appellant participated in the selection process for the post of 'para-teacher'. She claimed that she was at the top of the panel. Her claim was fortified when the State filed affidavit before us, wherefrom we find that she was at the top of the panel in respect of the Nayabad Free Primary School. The State has not appointed her as yet. They were taking the plea of an embargo as contended in the letter dated March 27, 2010 appearing at page 11 and 12 of the affidavit-in-opposition, wherefrom it appears that the Government decided not to appoint any para-teacher without appointing any regular teacher in primary and upper primary School.
(2.) Mr. Tapabrata Chakraborty, learned Counsel appearing for the appellant has drawn our attention to the affidavit-in-reply, wherefrom we find that the State did give appointments to other in the same District ignoring the notification referred to above. Mr. Chakraborty contends that once they deviated from the notification they must give appointment to the appellant.
