JUDGEMENT
ANIRUDDHA BOSE,J. -
(1.) Affidavit-in-opposition has been filed on behalf of the petitioner no.5 to the supplementary affidavit of the respondent nos.1 and 2. Let the same be kept with the record.
(2.) The subject of controversy in this writ petition relates to promotion of the petitioners from clerical cadre to the grade of Officer Scale - I. There are altogether five petitioners in this proceeding who were all in the clerical cadre of the respondent Bank. Out of these five, the petitioner no.1 has been promoted after he had filed another writ petition challenging a subsequent promotional process.
(3.) Mr. Ali, learned senior counsel prays for appropriate direction requiring the Bank to promote the petitioner nos.2 to 5 to the Grade of Scale - I Officer arguing that as per the promotional policy of the Bank they were entitled to be placed in the said post. Mr. Ali has argued that since the petitioners were deprived from promotion for a long period of time due to Bank's own fault, their promotion ought to be with retrospective effect with consequential benefits in salary and other emoluments.;
