JUDGEMENT

BISWANATH SOMADDER,J. - (1.) Affidavit of service filed in Court today be kept on record.
(2.) Having heard the learned advocates for the parties and upon perusing the instant writ petition, it appears, prima facie, that the decision of the appellate authority which is under challenge does not disclose any reason.
(3.) Under clause 15 of Rule 108 of the West Bengal Co-operative Societies Rules, 1987, an employee who is aggrieved by an order passed in a disciplinary proceeding has a right of appeal against such order. It appears that in the facts and circumstances of the instant case, such right was duly exercised by the petitioner. However, the impugned order which was communicated by the Chairman of the concerned Co-operative Society Limited by a letter dated 23rd September, 2010, merely states that the appeal was placed before the Special General Body meeting on 5th September, 2010, and after a detailed discussion, the delegates present unanimously declined to reconsider the decision of the petitioner's dismissal from the services of the Society. The decision taken by the Board on 26th September, 2008, affirmed by the General Body on 2nd October, 2008, was, thus, reaffirmed by the Special General Body meeting, which was held on 5th September, 2010.;
