JUDGEMENT
JAYANTA KUMAR BISWAS,J. -
(1.) The petitioner in this WP under Article 226 dated December 9, 2011 is seeking the following principal relief:
"A)Writ of and/or in the nature of Mandamus commanding the respondents, their officers, subordinates and agents -
(i) to forthwith take steps to ensure safety and protection of the life and liberty in compliance with the Memo No.63-P(PGAO),dated 13.1.2010 issued by the Joint Secretary, Govt. of West Bengal
(ii) to forthwith take steps for restoration of the possession jwellary shop, plot No.3/1168, PS. Gayeshpur.
(iii) to forthwith take necessary steps for renewal of the Trade License."
(2.) The memo dated January 13, 2010 referred to in prayer (A) is at p.26, and it is a letter of a Joint Secretary to the Government of West Bengal, Public Grievance Cell to the District Magistrate, Nadia. By the letter the Joint Secretary requested the District Magistrate "to ensure safety and protection of the life and properties of the petitioner and her relations." The Joint Secretary also directed the District Magistrate to "cause an enquiry" and submit "a detailed report."
(3.) Counsel submits that since the owners of the immovable property in question forcibly took possession of the jewellery shop with the help of some anti-social elements, the petitioner requested the respondents to take step for recovery of possession of the shop and give her possession thereof. According to him, the respondents were under an obligation to make an inquiry, recover possession of the jewellery shop, and give the petitioner possession thereof.;
