JUDGEMENT

(1.) The victim was a bachelor. He was working as khalasi of the vehicle. He died at the accident leaving him surviving his old parents. The Tribunal disbelieved the income, as suggested by the claimants. The Tribunal assessed the income notionally at Rs. 15,000/ Pertinent to note, the accident occurred in 2002. If we follow the decision in the case of Lakshmi Devi v. Md. Tabbar, reported in 2008 (2) W.B.L.R. 585 : 2008 (2) T.A.C. 394 (S.C.) , and notionally reduce the income from Rs. 3,000/- considering the fact that the accident occurred in 2004 in the case of Lakshmi Devi whereas the accident in the present case occurred in 2002, the income should be assessed at Rs. 2,800/- per month. Hence, the net income would be Rs. 2,800/- x 12 = Rs. 33,600/- less 1/2 = Rs. 16,800/-. The Tribunal applied the multiplier of 17. The mother was 45 years old as per evidence. Mr. Das contends that it should be 13 considering the age of both the parents.
(2.) Hence, the compensation would come to Rs. 16,800/- x 13 = Rs. 2,18,400/- + Rs. 9,500/- (general damage) = Rs. 2,27,900/-.
(3.) The said amount would carry interest @ 9% per annum, as directed by the Tribunal.;
