JUDGEMENT

(1.) Admittedly the petitioner participated in the selection process on the basis of an order passed by this Court on 27th September, 2007 in W.P.No.18546(W) of 2007. It was made clear in the said order that the order of allowing him to appear in the interview, however, does not give any right to the writ petitioner for being appointed to the concerned post, which shall only be made strictly in accordance with law.
(2.) The panel which was prepared in the said selection process was not approved by the concerned District Inspector of Schools with the following order:-
"Recruitment rules speaks a negative to the appointment so the school authority is requested to recaste the panel accordingly. "
The legality of the said order is under challenge in this writ petition.
(3.) Though it is rightly pointed out by Mr. Bari, learned Advocate, that the said order does not convey any meaning but still then this Court cannot overlook the basic fact that the petitioner who was aged about 39 years 10 months 20 days as on the date of interview was not an eligible candidate for the said post as he crossed the maximum age limit of the candidate for the said post which was prescribed as 37 years. Even without entering into the legality of the said impugned order, this Court holds since the petitioner admittedly crossed the maximum age limit as on the date of holding the interview, the petitioner was not an eligible candidate to participate in the said interview.;
