JUDGEMENT
ASHOKE KUMAR DASADHIKARI,J. -
(1.) Mr. Bose, learned Counsel appearing for the writ petitioner submits that they have taken voluntary retirement and at the time of voluntary retirement a promise was made by the Director (Personnel) of the respondent company, Hindustan Copper Limited, Head Office at Calcutta by their circular dated 20th February, 1995. Mr. Bose points out that the concerned organiser promised to the employees that employees who have retired/will be retiring under the Company's Voluntary Retirement Scheme will be entitled to wage revision/pay revision benefits as and when the same is finalised.
(2.) It also appears from the records which is the office memorandum of the Ministry of Heavy Industries and Public Enterprises dated 8th December, 2000 that ex-gratia will be re-calculated on the basis of revised pay scale and the difference will be paid.
(3.) Mr. Basu also points out that under clause 15 of the aforesaid memorandum it was clarified that the new scheme has been introduced in the supersession of the old scheme. It also appears from the writ petition that the representation was also submitted by the concerned employee before the Chairman-cum-Managing Director of M/s. Hindustan Copper Ltd. for arrear payment but unfortunately the same was rejected by the concerned General Manager.;
