JUDGEMENT

- (1.) The appellant participated in the selection process for the post of 'primary teacher' conducted by Kolkata Primary School Council. She was not selected. She filed a writ petition. The learned Judge dismissed the same on the ground that it did not deserve any interference at the stage when the selection process was over. The appellant writ petitioner applied under the Right to Information Act before the Council to know her status in the said selection process. The Council informed her that she secured 6.5 marks in the written examination. Her academic score was 32 marks, whereas the lowest number in the Schedule Tribe category was 33.87. The Council also informed her that her name was struck off as she did not have mathematics as a subject in her school leaving examination. Pertinent to note, she passed out Secondary Examination from National Open School, which was considered equivalent to Madhyamik Examination.
(2.) Being aggrieved, she has filed the instant appeal.
(3.) Mr. P.S. Bhattacharjee, learned Counsel appearing for the appellant contends that as per Recruitment Rules, the qualification for the post was Madhyamik or equivalent. Since, the candidate passed out School Leaving Examination from the National Open School, she should be considered as eligible for the post.;
