JUDGEMENT
ANIRUDDHA BOSE,J. -
(1.) The writ petitioner was issued licence as a dealer under the West Bengal Public Distribution System (Maintenance and Control) Order, 2003, under licence no. Sal-19.
(2.) The licence under normal circumstance would have been valid till 31st January, 2012. On 3rd September, 2010, the petitioner sent a letter to the Sub-Divisional Controller Food and Supplies, Bankura expressing his desire of surrendering his licence and requested the authority to accept the said resignation letter. Ill health was the ground shown as the reason for taking such step. Thereafter the petitioner had made a fresh representation seeking to withdraw the letter of surrender. In this writ petition his complain is that the authorities are not acting on the basis of his second representation. Nor have they communicated any decision to him in respect of his surrender letter.

When the matter was called on, however, Mr. Sinha, learned Counsel appearing for the State respondents produced an order issued by the Sub-Divisional Controller on 7th December, 2011 indicating acceptance of resignation of the petitioner on 28th November, 2011. Mr. Bhattacharyya, learned Counsel appearing for the petitioner submits that after waiting for such a long period of time the authorities should not have had accepted the letter of surrender without considering his client's subsequent representation seeking to withdraw the letter of surrender.;
