JUDGEMENT

(1.) THE petitioners in this WP under art.226 of the Constitution dated
January 20, 2006 are questioning a decision of the West Bengal Board of Secondary
Education. A copy of the decision was sent to the Secretary of the school concerned with
a letter of the Secretary of the Board dated August 16, 2005 (WP p.110).
(2.) THE relevant parts of the letter dated August 16, 2005 are quoted below:-
"The Recognition Committee of the Board considered the Govt. views vide No.169-SE (Law) dt.23.3.2005 and the DLIT report u/s 19(3) of the Act and Resolved that the Committee regrets its inability to recommend recognition of Sukanta Smriti Vidyapit, Hooghly on the grounds mentioned below:- 1. A few students were present at the time of inspection. 2. The School authority did not fulfil the norms and condition as laid down in connection with first recognition as 4-class Jr. High School. 3. The DLIT did not recommend the school for its recognition. 4. The Education Deptt. also did not recommend the school. The Recognition Committee further resolved that the matter be referred to the Executive Committee of the Board for its final decision. The Executive Committee of the Board in its meeting dt.16-04-2005, considered the above recommendation of the Recognition Committee u/s 19A(3)(c)(i) of the Act, 1963, as amended, and ratified the same. "
A school called Sukanta Smriti Vidyapith (Junior High) was set up at Senpur village of the district Hooghly. Persons interested in the recognition of the school applied
for recognition. Consequently, the District Level Inspection Team inspected the school and submitted its report. The team did not recommend recognition on the grounds that
infrastructure was insufficient. Accordingly, the Government did not recommend
recognition of the school.
(3.) MR Manna appearing for the petitioners submits as follows. The District Level Inspection Team submitted the report without inspecting the school. It wrongly reported
that on the date the school was inspected only a few students were present. Though
common room for the girl students was not there, it was built subsequently. The Board
should be directed to recognise the school.;
