ANIRUDDHA BOSE,J. - (1.) This writ petition is being taken up for hearing at this stage only without calling for any affidavit. Records have been produced by the State respondents, and in my opinion, the disputes raised in this proceeding can be adjudicated upon on the basis of such records only.
(2.) The subject of dispute in this writ petition is appointment of a distributor under the West Bengal Public Distribution System (Maintenance and Control), Order, 2003 at Assam More in the district of Jalpaiguri. The writ petitioner is one of the contenders for being engaged as a distributor in respect of the said vacancy. Through a verification process, the Sub-Divisional Controller and the Controller had found him eligible for such appointment among the contending candidates. In a report dated 10th October, 2006 the Sub-Divisional Controller, Food and Supplies, Jalpaiguri had prepared a panel in order of merit and the name of the petitioner was in the first position in that panel. A copy of this report has been made annexure "P4" to the writ petition. Such recommendation was also concurred with by the District Controller, as it appears from a copy of a memorandum bearing number 2623 dated 16th October, 2006 issued by the District Controller, Food and Supplies, Jalpaiguri which has been annexed as "P5" to the writ petition.
(3.) It appears that the matter was reexamined and the Deputy Director (Supply) wanted reassessment of the status of the respective aspirants. In a note prepared by the Director, D.D.P. &S., it was observed that no specific recommendation in respect of a particular candidate was made. It was observed that no report was made for loading and unloading facility and approach road. Re-enquiry was directed in the matter to be conducted by a Senior Deputy Director, Habibul Ahsan.;
