JUDGEMENT

- (1.) THE Judgment of the Court was as follows : The petitioner's father was Assistant Teacher in Paraganas Deulpur Primary School and died -in- harness on 28.4.1978.
(2.) THE said deceased left behind him surviving the widow and four minor children. Within the reasonable period, an application was taken out by widow seeking her appointment in commensurate with her qualification. The said application is kept in abeyance by the authority which would also be reflected from the impugned order. Subsequently , the widow made another application praying for an appointment of the petitioner who, by this time attained majority and also acquired eligible qualification.
(3.) THE concerned Sub-Inspector of School recommended the petitioner to the concerned Chairman for his appointment as the family is in financial distress. In spite of the said recommendation, no step was taken which constrained the petitioner to move before this Court by filing W.P. No. 21498(W) of 1999. While disposing of the said application, this Court directed the Director of School Education, West Bengal, to treat the writ petition as representation and to dispose of the same by passing a reasoned order. By the impugned order, the said authority rejected the said application of the petitioner on the ground that he attained majority after thirteen years of the death of the teacher and the application filed by the mother does not deserve to be entertained as she does not have requisite qualification for appointment to the post of primary school teacher.;
