ASHIM KUMAR BANERJEE,J. - (1.) We have heard Mr. Aniruddha Chatterjee, learned counsel, appearing for the appellant and Mr. Sakhya Sen, learned counsel, appearing for the respondents in the appeal.
(2.) The facts would depict that the probate proceeding is still awaiting its disposal by the learned District Judge, 24 Parganas (South).
(3.) Mr. Chatterjee contends that despite order of status quo, the building was constructed.;
