JUDGEMENT

ANIRUDDHA BOSE, J. - (1.) Though this writ petition has been listed today under the heading 'Extension of Interim Order', the writ petition itself is being taken up for hearing as the Indian Oil Corporation, the main respondents in this matter have produced the relevant records.
(2.) The writ petitioner was an applicant for being engaged as a distributor of Liquid Petroleum Gas (LPG) under the 'Rajiv Gandhi Gramin LPG Vitrak (RGGLV)' Scheme. The location for which the petitioner had applied for distributorship of LPG gas is Nageshwarpur in the district of Malda. This location has been specified against serial no. 49 of the advertisement issued on 17th October, 2009 inviting applications from aspiring distributors. There are various eligibility criteria prescribed in the scheme, but for the purpose of adjudication of this writ petition, two of these criteria are relevant. The first one is that an applicant would have to be a resident of the town/village of the advertised location for which such person applies for distributorship and he should own suitable land of minimum 20 meters X 24 meters in dimension at the said location. So far as the latter requirement is concerned, it has been stipulated in the scheme that the ownership title of the land may belong to the family members of the family unit of the applicant. Thus title of the land need not vest in the applicant himself.
(3.) In this case, the petitioner had applied with particulars of ownership of land in the name of his wife, Laxmi Ghosh in mouza-Moregram, J.L. No. 87 and Khatian No. 2028. A photocopy of the record of rights has been annexed to the writ petition, in which the name of the wife of petitioner is shown as riyot occupier in respect of dag nos. 510, 511 and 512.;
