JAYANTA KUMAR BISWAS,J. - (1.) The petitioners in this WP under Article 226 dated January 25, 2012 are alleging that though they were entitled to get tender paper for participating in the process initiated by West Bengal Power Development Corporation Limited (in short WBPDCL), for undisclosed reasons tender paper was not supplied to them.
(2.) In the tender notice dated December 20, 2011 at p.47 it was mentioned that tender papers would be sold during the period from December 26, 2011 to January 10, 2012. The last date for submission of tender papers was fixed for January 30, 2012 upto 13-00 hrs. It was also mentioned that the tenders would be opened on January 30, 2012 at 15-00 hrs.
(3.) Mr. Sarkar appearing for the petitioners submits as follows. The first petitioner submitted the application dated January 10, 2012 (at p.48) on behalf of a joint venture. With the application it submitted all documents in proof of the eligibility of the joint venture. Hence WBPDCL could not refuse to supply its tender paper, especially when payment for the tender paper was made.;
