- (1.) The Court: Mr Sanyal submits under instructions that on the same cause of action on which this WP has been filed the petitioner had previously filed a WP that was dismissed for default. He has said that the petitioner ought to have taken steps for restoration of the previous WP. He concedes that this WP is not maintainable.
(2.) The last order dated September 25, 2012 passed in this WP is quoted below: "Mr Majumdar submits that on the same cause of action the petitioner has filed a previous WP. It is necessary to see what was the subject matter of the previous WP. Hence hearing of this WP is adjourned. to next monthly list as motion. Certified xerox. "
(3.) In view of the above-noted situation, I dismiss this WP. No costs. Certified xerox.;
