JUDGEMENT
DIPANKAR DATTA,J. -
(1.) The writ petitioner applied for supply of electricity. The Electricity Department agreed to supply electricity but since the petitioner is residing on the land belonging to the Navy, the latter did not permit the department to draw line and to erect post for supply of electricity to the petitioner.
(2.) Feeling aggrieved, the petitioner has presented this writ petition seeking a direction on the Electricity Department to supply electricity notwithstanding the objection of the Navy.
(3.) Mr. Das, learned advocate representing the Navy contends that the petitioner is an encroacher of land belonging to the Navy and, therefore, the petitioner is not entitled to supply of electricity. However, replying to a query of the Court, he submits that no proceeding for eviction of the petitioner has yet been initiated.;
