JYOTIRMAY BHATTACHARYA,J. - (1.) The petitioner was appointed as an Assistant Teacher in the Physical Education group in Nandakumarpur High School (H.S.). His appointment as an Assistant Teacher in the said school was approved with effect from 21st June, 1990. At the time of his appointment, his educational qualification was B.A.B.P.Ed. Subsequently, he enhanced his educational qualification by acquiring Master Degree in Bengali from Rabindra Bharati University in 1994.
(2.) The concerned District Inspector of Schools also allowed his prayer for grant of post graduate scale of pay for his enhanced qualification with effect from 1st January, 1997 as per G.O.No. 57 (SE) dated 27th January, 1995, as he increased his qualification by acquiring Master Degree in Bengali and was taking 24 Bengali classes in a week in addition to his normal works with a rider that he will be absorbed in language group as and when vacancy will be created in the language group.
(3.) Subsequently on the retirement of an Assistant Teacher, viz., Sanjib Kumar Ghosh, a vacancy in the post of Assistant Teacher in the language group was created in the higher secondary section of the said school.;
