JYOTIRMAY BHATTACHARYA,J. - (1.) The petitioner submitted an application form for correction of his date of birth in the records maintained by the West Bengal Board of Secondary Education. The date of birth of the petitioner was recorded in the Register maintained by the West Bengal Board of Secondary Education which shows that 4th May, 1955 was recorded therein as the date of birth of the petitioner.
(2.) The petitioner passed the Higher Secondary Examination in 1972. Long thereafter the petitioner submitted the said application for correction of his date of birth. The petitioner now claims that his date of birth was 14th January, 1956. In support of such claim of the petitioner he submitted various documents including the Birth Registration Certificate issued by the Municipal Authority.

In response to the petitioner's said application for correction of his date of birth, the Deputy Secretary (Records) of West Bengal Board of Secondary Education by his letter dated 28th May, 2010 directed the petitioner to submit xerox copy of the Admission Register (Relevant Page) from the Primary School where he was admitted. The School Authority intimated the petitioner that since the school records during the relevant period were all destroyed by flood, such document cannot be supplied to the petitioner.;
