ANIRUDDHA BOSE,J. - (1.) Supplementary Affidavit filed in Court today be kept on record.
(2.) The writ petitioner is due to retire from his service in Eastern Coal Fields Ltd. on 29th February, 2012. The superannuation of the petitioner on that date will take place on the basis of the petitioner's date of birth being 9th February, 1952.
(3.) The case of the petitioner however is that his actual date of birth was 14th November, 1953. In support of his claim he has relied on a copy of admit card issued by the Board of Secondary Education, Assam which records that on 1st March, 1970 the date of birth of the petitioner was 16 years three months and 18 days. The "High School Leaving certificate" Examination issued by the Board of Secondary Education, Assam in the name of Raj Kumar Agarwala records the same age as on the said date, that is, on 1st March, 1970.;
