JUDGEMENT
BISWANATH SOMADDER,J. -
(1.) Having heard the learned advocates for the parties and upon perusing the instant writ petition, this Court directs the respondent no.3, being the Sub-Divisional Officer, Domkal or any other competent officer not below the rank of a Block Development Officer, to file a report in the form of an affidavit on the next date, stating therein the entire factual aspect of the matter as available from record. Re: CAN 10615 of 2011.
(2.) So far as the instant application for intervention is concerned, it appears that the same has been taken out by six applicants who have sought to intervene together in the instant writ proceeding and have prayed for an order to add them as parties to the instant writ proceedings and also to dismiss the writ petition.
(3.) Although it has been specifically contended by the learned senior counsel representing the writ petitioner that the applicants have no locus in the instant matter, this Court is of the view that since it has been claimed by the applicants that they have licence to operate a 'Cattle Hat' situated in the adjacent area and the subject-matter of dispute as sought to be raised by the writ petitioner also relates to a 'Cattle Hat', it would be fit and proper to add the applicant no.1 as respondent in the instant writ proceeding, keeping the point of locus standi of the said applicant open to be decided on the next date.;
