JUDGEMENT

ASHOKE KUMAR DASADHIKARI,J. - (1.) Mr. Ghosh, learned counsel appearing in support of the petition submits that only Rs. 10 Crore was released against the dues of the petitioner. He submits that further amount of money is lying in the hands of Official Liquidator. He also submits that the balance claim of the petitioner should be paid by the Official Liquidator. Learned counsel appearing for the Income Tax authorities submits that, although Income Tax dues are there, they have not placed any claim before the Official Liquidator. Learned counsel appearing for the Official Liquidator submits that there are other unpaid dues also.
(2.) Heard the submissions made by the learned Counsel for the parties and considered the same. I do not want that the entire money should be released in favour of the petitioner. I direct the Official Liquidator to release Rs. 2 crore in favour of the petitioner for the present, within a week from date and the balance amount of money is to be kept with the Official Liquidator. For the purpose of making the payment to the petitioner, the Official Liquidator is permitted to encash prematurely any fixed deposit or instrument to the extent it required. In case, the Income Tax authorities lodge any claim, that would be adjudged by the Official Liquidator in accordance with law and the Official Liquidator is permitted to take a decision.
(3.) Mr. Ghosh submits that his client should be allowed to prefer further application since the aforesaid payment would not saturate the claim of the petitioner. Such leave is granted.;
