JUDGEMENT

Hrishikesh Banerji, J. - (1.) This appeal is directed against the Judgment date: November 19, 1999 by the Court of Commissioner (3rd), Workmens Compensation, West Bengal. The respondent-workman, Y. V. Murty a sea-man filed Claim Case No. 224 of 1993 against the Shipping Corporator of India Ltd., the appellant herein claiming compensation of Rs. 4,03,895/-.
(2.) The respondent's case is that following the employment injury he sustained on board the vessel, M.T. Dadabhai Naroji' on 8.2.1992 he suffered 100% loss of earning capacity. While working in the aforementioned vessel in the Port of Singapore, the respondent met with the accident and sustained serious injuries on his legs, knees and other parts of the body when he fell down from the greasy stairs on board the ship. He underwent treatment at Singapore, Bombay and Calcutta.
(3.) Initial treatment was provided in the ship by the Medical Offer February 10, 1992. Latter the Medical Officers of the appellant/Corporation found the respondent unfit for the job of a sea-man. The total emolument the respondent at the time of the accident was Rs. 11,000/- per mot Inspite of demands the appellant did not pay the claimed compensation found respondent.;
