Pranab Kumar Chattopadhyay, J. - (1.) . - Petitioners herein were appointed as Stenographers/Steno Typists under Calcutta Municipal Corporation and were posted at various departments of the said corporation along with the respondent Nos. 5,6 & 7 herein. The petitioners have challenged the promotions of the respondent Nos. 5 to 7 to the higher scale of pay and grade inspite of being placed below the petitioners in the Gradation list of Stenographers/Steno Typists.
(2.) The petitioners were appointed along with the respondent Nos. 5 to 7 as Steno-Typists in the scale of pay of Rs. 380-910 (Pre-revised) and after revision the said scale of pay was fixed at Rs. 1260-2610.
(3.) The authorities of the Calcutta Municipal Corporation published a final Gradation list of Steno-Typists who were appointed upto 31st July 1987 wherein the names of the petitioners were shown against Serial Nos. 4,5,6,7,8,9,12,13 and 14. The names of the respondent Nos. 5, 6 and 7 were placed in the said Gradation list at Serial Nos. 10,11 and 16. Accordingly, the petitioners were shown as senior to the respondent Nos. 5 to 7 herein in the finally published Gradation list of the Steno-Typists.;
