JUDGEMENT

(1.) Shri Manas Kumar Chakraborty, the writ petitioner has challenged the order of the Central Administrative Tribunal (Calcutta Bench) dated 19.10.2001 whereby the prayer of the petitioner made before the said Tribunal for quashing the Notification Annexure 'B' dated 23.5.2001 of the application made before the Tribunal (subsequently amended vide order dated 10.7.2001) appointing Shri Dinesh Chandra Bajpai was rejected. '
(2.) The undisputed facts as disclosed from the pleadings and submissions of the contesting parties are as follows :
There are four posts of Director General of Police (D.G.P) in the State of West Bengal, namely - (a) Director and Inspector General of Police (b) Director General and Commandant General, Home Guards (c) Director, Training and (d) Director, Intelligence. Shri Manas Kr. Chakraborty and respondent No. 6, Shri Dinesh Chandra Bajpai both belonged to 1966 batch of I.P.S. and in the merit list, the applicant Mr. Chakraborty holds 2nd position while respondent No. 6, Shri Bajpai holds 6th position.
(3.) On 28.2.2001, Shri D.K. Sanyal, since retired on 30.4.2001 has holding the post of Director General and Inspector General of Police and the present writ petitioner was holding the post of Director General Commandant General, Home Guards and in fact, he is still continuing with that post, while Shri D. Banerjee and Shri S.K. Ghosh were holding the post of Director, Training and Director, Intelligence respectively.;
