JUDGEMENT

- (1.) The petitioner was appointed in Medical Teaching Service in 1983. She was transferred to Nil Ratan Sarkar Medical College, Kolkata in 1985. She served Kolkata service for eight years.
(2.) In 1993, she got promotion on transfer to Burdwan Medical College. She served there for two years and came back to NRS Medical College again and served the Kolkata posting for five years. She was transferred to North Bengal Medical College on January 10, 2000. Within nine months, she came back to NRS Medical College again on October 03, 2000 and is still serving. She is due to retire on November 30, 2012.
(3.) In 2006, the State attempted to transfer her to Bankura Medical College that failed with the intervention of the Tribunal. Similar attempt was made in 2009 for her transfer to Medinipur Medical College that also failed due to litigation. This time, she approached the Tribunal with the prayer that she must be allowed to stay at Kolkata and retire from NRS Medical College as she had only eleven months left. Tribunal rejected her prayer. Hence, this application.;
