JUDGEMENT

(1.) The petitioners five in number are working as TeJinical Assistants (Civil) in different offices under the Calcutta Metropolitan Development Authority (for short CMDA) and claim that they are qualified to be promoted to the post of Assistant Engineers (Civil) by virtue of more than eight years of service under CMDA. Relying upon a resolution dated 15th September, 1995 whereat allegedly decision was taken in the meeting of the Selection Committee held for selection of Assistant Engineers (Civil), inter alia, that 71 (seventy one) post of Engineers were then lying vacant and the Selection Committee considered the draft of the circular to be issued for inviting applications from the departmental candidates who fulfilled the necessary criteria. By a circular dated 13th November, 1995 (Annexure E), CMDA invited applications from the employees of CMDA who are eligible as per qualifications and experience for filling up the vacant posts of Assistant Engineers (Civil) in CMDA. Pursuant to the said circular dated 13th November, 1995, petitioners as also the added respondent Pradip Bhattacharyya duly applied and appeared in the written test which was held on 30th June, 1995.
(2.) Earlier thereto, on 31st August, 1995 requisition was sent to employment exchange for sponsoring names of eligible candidates (Annexure G) for filling up the eleven (11) posts of Assistant Engineers (Civil) in CMDA.
(3.) Also, an advertisement dated 12th November, 1995 (Annexure H) was published in various newspapers by the CMDA inviting applications for filling up 11 vacant posts of Assistant Engineers (Civil) in CMDA. Those successful in the written test, such candidates were invited to appear in the interview to be held on 14th October, 1996 for filling up the 11 posts of Assistant Engineers (Civil).;
