PROKASH CHANDRA MALLICK, J. - (1.) C.R. 8729 -w/85 was filed by the applicants in the Calcutta High Court on 3.7.85 praying for a direction to the respondents : (a) to assign seniority to the applicants with effect from 1.10.1980 on the basis of Railway Board's letters dated 18.6.81 (Annexure -B) and 31.7.81 (Annexure -C) and D.R.M. Howrah's letter dated 4.10.81 (Annexure -K); (b) to withdraw, cancel, rescind and set aside the letter dated 10.4.85 (Annexure -J) rejected the joint appeal of the applicants for proforma promotion from 1.10.80; and (c) to withdraw, cancel and rescind the order of transfer dated 24.4.85 (Annexure -L) in respect of applicants 19, 20 and 21.
(2.) The writ application was received on transfer by this Bench under Sec. 29 of the Administrative Tribunals Act, 1985, and was registered as T.A. 1301 of 1986.
(3.) There are 21 applicants in this case. All of them are graduates and they were appointed in the Eastern Railway on different dates between 21.7.70 and 19.11.83. They became Clerks, Gr. II in the scale of Rs. 260 -400/ - on various dates between 20.3.78 and 19.11.83. Their relevant particulars are given at Annexure -A. They appeared for selection as Clerk, Gr. I on 12.2.84 and the panel was published on 18.1.85.;
