JUDGEMENT

(1.) The Registrar, Original Side, places a Report before this Court today. From the Report it transpires as follows: that (a) The Deputy Commissioner
of Police (DCP), Port Division, Kolkata, having his office at 1, Dumayne
Avenue, B.N.R. South Colony, Garden Reach, Kolkata - 700 043; (b) The
Officer-in-Charge, Ekbalpur Police Station; and (c) The District Engineer,
CESC Ltd., having his office at P-18, Taratala Road, C.P.T. Colony, New
Alipore, Kolkata - 700088 were delivered a copy each of the judgement
and order of this Court dated 12th February, 2020 in C.C. 41 of 2019 with
A.P.O. No.454 of 2017.
(2.) Unfortunately however, when the matter is called today, although the DCP, Port Division, Mr. Syed Waquar Raja and the Officer-in-Charge,
Ekbalpur Police Station, Mr. Amanullah, are present in Court in response
to the notice received by them from the Registry as recorded above, the
third recipient, viz. The District Engineer of CESC Ltd. is noticeably
absent.
(3.) This Court further notices that one, Mr. Durjoy Sarkar, the Executive Engineer of Borough no.XI, Kolkata Municipal Corporation, did not attend
the proceedings on time, although he was in knowledge of the direction
passed on the 12th of February, 2020 (supra) that he had to produce
photographs of the portions of the unauthorised building claimed to have
been demolished so far.;
