JUDGEMENT

JAYANTA KUMAR BISWAS, J. - (1.) The petitioners in this Article 226 petition dated January 19, 2010 are seeking several final reliefs including a mandamus commanding the respondents to delete from the list of sponsored candidates names of those candidates whose names were sponsored by the employment exchange considering their training qualification obtained from unrecognized institutes.

The North 24-Parganas District Primary School Council initiated a process under the 2001 Rules (old rules) for recruiting primary school teachers, and in connection with the process names were sponsored by the employment exchanges in 2006. Names of the petitioners were also sponsored. In terms of the interim and final orders passed in a batch of Article 226 petitions the council has taken further steps for concluding the process in which candidates whose names were sponsored in 2006 and who submitted their respective bio-data in prescribed form are to take the written test to be conducted by the council. According to provisions of the rules, the council has drawn up a shorlist and the petitioners are not on it. This has made them aggrieved.
(3.) Since the petitioners' names are not on the shortlist, they are not entitled to take the written test that is scheduled for January 31, 2010. Their case is that for inclusion of names of those candidates who got the benefit of sponsorship on the basis of invalid training qualification obtained from unrecognized institutes, they are not on the council's shortlist. According to them, candidates who got the benefit of out of turn sponsorship on the basis of training qualification obtained from unrecognized institutes being not at all eligible, the council could not consider their bio-data for examining whether they qualified- for inclusion in the shortlist.;
