JUDGEMENT

- (1.)THE petitioners apprehend their arrest in Crime No. 47/92, which was originally registered for the offences under sections 324, 325, 294 and 336 of IPC.
(2.)FROM the perusal of the impugned order, it appears that the accused persons were released on bail on 16.9.92 and have enjoyed the liberty so far. Now on the receipt of the X'ray report; the offence is sought to be converted under section 326 of IPC. There is no allegation that during the period of liberty, for the last about three years, the petitioners have misused the freedom in any manner. Without meaning to comment on the merits of the case, the application deserves to be allowed.
The petitioners shall be released on bail, in the event of their arrest in Crime No. 47/92, registered for the offence u/s 326, IPC, on their furnishing personal bonds in the sum of Rs. 7,000/ - with one solvent surety in the like amount, in each case, to the satisfaction of the Police Officer competent to arrest them u/s 438 Cr.P.C. The petitioners shall appear before the concerned Police Station within a period of fifteen days from today, else the order shall become ineffective after the period of fifteen days.
