JUDGEMENT

Jagannadha Raju, J. - (1.)In this Writ Petition which has been taken up on a telegram issued by Sri N.y. Krishnaiah to our learned brother M.N. Rao, J., the allegation is that Sri Parameswara Rao, President, A.P. Civil Liberties Committee, Srikakulam district was kidnapped by the Police, Srikakulam on 25/1/1992 and he has been kept in illegal custody.
(2.)The Police filed a detailed counter through the Advocate-General. It is asserted that Parameswara Rao was never arrested and he was brought to Police Station for the purpose of making enquiries about certain people alleged to have been kidnapped by the P.W.G. group of naxalities. The petitioner's counsel, after verifying the contents of the counter, informed the court that after the employees who were kidnapped by the P.W.G. group were released by the P.W.G. group, Parameswara Rao was also released. Now the alleged detenu is not in custody, the writ petition has become infructuous. Hence the Writ Petition is dismissed.
(3.)It is open to the petitioner to take such proceedings as he deems fit if his allegations about harassment, torturing etc., are true.
