(1.)Appellant is the sole accused in S.C.No. 86/91 on the file of the sessions
Judge, Vizianagaram. He was charge-sheeted for the offence under Section 302
IPC alleging that on 27-5-1991 at about 1 p.m. at Kannapudoravalasa village he
committed murder of his wife MaradanaGanga (hereinafter called asdeceased)
by pouring kerosene on her body and setting fire to her. Accepting the case of
the prosecution, the learned Sessions Judge convicted and sentenced the
accused to suffer imprisonment for life by Judgment dt. 3-3-1992. Aggrieved by
the same, the present appeal has been filed.
(2.)Heard the learned Counsel for the appellant and the learned Public
(3.)The prosecution has examined P.Ws. 1 to 13 and marked Ex.P-1 to P-14.
P.W.I is the mother of the deceased. P.W.2 is the brother of the victim. P.W.3 is
the wife of one of the brothers of the deceased. P.Ws. 4 and 5 are the residents
of the same village who are witnesses to circumstances prior to and after the
incident. P.W.6 is the Medical Officer who treated the victim in the hospital and
who conducted autopsy over the dead body of the deceased. P. W.7 is the doctor
who treated the accused for his bums. P.W.8 is the Prl. District Munsif,
Parvatipuram, who recorded the dying declaration of the deceased in the
hospital. P.W.9 is one of the inquestdars. P.W.10 is the S.I. of Police
Parvatipuram town P.S. who recorded the statement of the deceased in the
presence of P.W.6. P.Ws. 11 to 13 are the investigating Officers in this case.
