(1.)These Civil Revision Petitions are directed against a common order of the learned Subordinate Judge, Guntur in C. M. A Nos. 5 & 6 of 1970 on his file by which the orders of the Rent Controller in A. B- A. Nos. 12 and 13 of 1969 on his file were confirmed and eviction of the tenants from the building in question was directed.
(2.)The tenants are the revision petitioners who are occupying non residential buildings owned by the respondents herein carrying on their business. The landlords filed A. B. A. Nos. 12 and 13 of 1969 stating that the premises which they are occupying for the purpose of carrying on business as tenants has become old and dilapidated and is likely to collapse. It was stated that the owners of the building are not effecting any repairs to the building and are pressing for vacating the same. As the business of the lanloard is on the increase, additional accommodation has also become necessity which is not available in the premises now occupied by them.
(3.)The tenants resisted the petitions firstly on the ground that the landlord being already in possession of non-residential premises and carrying on business, is not entitled to obtain eviction of the tenant for the purpose of his business ani secondly on the ground that the requirement of the landlord to be put in possession of the building is not bonafide. The Courts below held against the tenant on both these contentions.
