(1.)This is an application filed under Article 226 of the
Constitution for the issue of a writ of certiorari
to quash the order issued by the
Divisional Superintendent, Commercial
Branch, South Central Railway, Vijayawada, dated 12th June, 1970. It
arises in the following circumstances :
The petitioner was a receptionist in the
Railway hotel, Aurangabad. There
were certain complaints about his
behaviour. He was therefore suspended
on 28th December, 1966.
(2.)On 7th January, 1967 when the
matter was referred to the Enquiry Board,
three charges were framed. The first
two related to his unauthorised entry into
the Ladies Tourist Room under influence of liquor and the third also related
almost to a similar incident.
(3.)During the course of enquiry by thb
Board on 4th March, 1967, the Board
came to the conclusion in the light of
the evidence so far recorded, that two
additional charges were required to be
framed against the delinquent officer.
They, therefore, framed two additional
charges. One related to his dereliction
of duty inasmuch as he left on 27th
November, 1966 the godown of which
he was the manager without issuing the
necessary supplies and taking precaution
for its protection. The second charge
was that on 26th/27th November, 1966
and on other dates, he falsifield the
accounts and misappropriated some
money. He was given an opportunity to
meet these two additional charges.
