JUDGEMENT

(1.) THIS is an appeal against the order dated 19.5.2000 passed by the District Forum, Haridwar whereby the complaint of the complainant was allowed for the recovery of insured amount on the death of her husband along with bonus and penal interest @ 18% from 1.1.1997 till the date of actual payment. The complainant was also awarded a cost of litigation of Rs. 1,500/ -.
(2.) THE brief facts of the case are that the husband of the complainant namely Sh. Sunder Lal Sharma had taken a Policy No. 270258955 for Rs. 25,000/ - from the opposite party. The premium was regularly paid. The policy was a non -medical policy. Unfortunately her husband died on 5.1.1996. His death was a natural death. Being the nominee of the policy, she lodged the claim with the Insurance Company on 4.12.1996 but the payment was not made. On the request of opposite party, she submitted all the details of leave of her husband from August 1992 to December 1995 from his department. Still the amount was not paid. Then she sent a legal notice through her Advocate on 22.4.1997. But she was not heard. Then she filed the complaint before the learned Forum.
(3.) THE opposite party filed written statement and alleged it is wrong to say that the husband of the complainant died a natural death. It is said that her husband died due to P.T.B. and the claim of the complainant was repudiated vide registered letter dated 8.8.1997. There is no deficiency in their service. The claim of the complainant has been repudiated on the ground of concealment of material fact by the insured. There has been no delay in taking the final decision. The notice of the complainant was timely replied. It is further alleged that the complaint is liable to be dismissed.
Both the parties filed their affidavit and other relevant documents in support of their allegations. The learned Forum after taking the evidence of the parties and hearing them allowed the complaint as above, against which order the present appeal has been filed.;
