JUDGEMENT

(1.) THIS is a tenant, writ petition arising out of the Orders dated 5.4.99 and 5.6.97 passed by respondents No. 1 and 2. In proceedings under Section 21(1)(g) of U.P. Urban Buildings (Regulation of Letting, Rent and Eviction) Act, 1972. Respondent No. 3 is the landlady, she filed an application for release of the premise in dispute on the ground of personal need. This application has been allowed by the Courts below. Hence the present writ petition. The Courts below have held that her husband was wounded in Punjab, and she wants to live in Dehradun. On this basis, The Courts below have held that the need of the landlady to be bona fide, and also compared the hardship. There is no illegality in the same. The writ petition has no merit. It is dismissed.
(2.) HOWEVER , petitioner is widow and there is no male member in the family. The only member in her family is her daughter.
In view of this, the petitioner is granted 9 months time to vacate the premise in dispute provided she filed an undertaking in the form of an affidavit before the Prescribed Authority that she will handover the premise to the landlady within nine months and will pay the rent for the period of her occupation.
Petitioner is a widow, if she applies for allotment of any other premise. That may be symphatically considered by the Rent Control Authorities in accordance with law.;
