JUDGEMENT

- (1.) THE revisionists have been served with notice to engage a Coun sel of their choice in place of Mr. G. P. Mathur (Now Hon. G. P. Mathur, J.) but the revisionist has not in spite of service of notice on 12-10-1999, engaged any Coun sel for them.
(2.) THIS revision petition is more than 16 years old, accordingly, it is taken up for consideration and decisions with the help of materials on record. The lower Court record has been received. This revision petition is directed against the order dated 14- 6-1983 by which order the learned Sessions Judge, Budaun has transferred the part heard Sessions Trials including the Sessions Trial No. 352 of 1982 from the Court of IV Addl. Sessions Judge to Illrd Addl. Sessions Judge. No interest of justice has suffered by the impugned transfer order passed by learned Sessions Judge. Moreover, this transfer order was passed more than 16 years earlier and all the Presiding Officers of the year 1983 have been transferred from the judgeship of Budaun and now Cell of Officers must be in office there, therefore, at present the pendency of Ses sions Trial is against the interest of justice.
(3.) THE revision petition does not dis close merit and the same is accordingly dismissed. THE learned Sessions Judge Budaun is directed to see that ST No. 352 of 1981, State v. Ganga Ram and others, is transferred to the Court which is presided over by a Judge and the Sessions Trial is disposed of expeditiously preferably within six months from today. The office is directed to return back the lower Court record within a week for compliance of the order. Revision dismissed. .;
