JUDGEMENT

- (1.) GIRIDHAR Malaviya, J. We have heard Shri G. C. Saxena, learned counsel for the petitioner. It appears that the petitioner Ram Krishna alias Munna was wanted in Crime No. 114 of 1983 under Sections 467/468/472 and 120-B, IPC. He was granted bail by Chief Judicial Magistrate, Agra, in the said case by an order dated 29th September, 1987, which is Annexure-1 to this petition. The petitioner has also filed a supplementary affidavit. A perusal of the first infor mation report in Crime No. 114 of 1983 indicates that the Sector Officer of the Crime Department had directed separate crime to be allocated in respect of licences which were alleged to be forged and granted by the petitioner to various persons and which the subject- matter of Crime No. 114 of 1983 mentioned above.

THE contention of the learned counsel for the petitioner is that these crimes have now been registered as Crime Nos. 114-B, 114-E, 114-F, 114-C, 114-H, 114-1, 114-J, 114-K at Police Station Kamasin, Banda, the petitioner should have been permitted to remain on bail on those crimes on furnishing personal bonds as he had been granted bail by the Chief Judicial Magistrate, Agra, in Crime No. 114 of 1983. The petitioner for the relief should have moved the Chief Judicial Magistrate directly instead of coming to the High Court, as the Chief Judicial Magistrate himself was competent to grant this relief to the petitioner and he could have asked for personal bond separately in each of the Crimes with out asking for fresh sureties, as the sureties must have been furnished by the petitioner in Crime No. 114 of 1983. This petition is misconceived and is accordingly dismissed.
(3.) LET a certified copy of this order be furnisheu to the learned counsel for the petitioner within 24 hours on payment of usual charges. Petition dismissed. .;
