JUDGEMENT
DINESH KUMAR SINGH,J. -
(1.) Heard learned counsel for the applicant Shri Hari Prakash Mishra and in opposition, Shri Amit Kumar Singh, learned A.G.A. for the State and perused the record.

This application under Section 482 of Cr.P.C. has been moved on behalf of the applicant with a prayer to quash the impugned order dated 31.08.2019 as well as the entire proceedings of Special Case No. 07 of 2018, arising out of Case Crime No. 209 of 2018, under Section 7/11 of the Prevention of Corruption Act, Police Station - Kanth, District - Shahjahanpur.

It is emphatically argued by learned counsel for the applicant that it is bounden duty of the trial court to give reasons for rejecting the application for discharge, but in the present case, the learned trial court has not disclosed any reason and yet, the application for discharge was rejected cursorily. It is further argued that the applicant is an employee of State Warehouse Corporation, who had nothing to do with the works which have been mentioned in the F.I.R., in which it is alleged that some illegal amount was charged. The said allegation is totally false. He has drawn attention of this Court towards several affidavits which are annexed by him at Page Nos. 90-101 of the Case Diary, but has failed to point out as to before which authority, these affidavits were submitted. Further attention has been drawn towards one certificate purported to have been issued by one driver, namely, Prempal, but under what circumstances and before whom the said certificate was presented, he has not been able to disclose. He has argued that in such a situation, the impugned order passed by the trial court ought to be set aside and the matter should be remanded for deciding the matter afresh.;
