JUDGEMENT

(1.) The present contempt petition has been filed alleging non-compliance/defiance of the judgement and order dated 19.5.2017 passed by this Court in Writ Petition No.1560 (SS) of 2015.
(2.) The aforesaid writ petition was instituted by 24 petitioners seeking quashing of the order passed by the State Government dated 16.7.2014, whereby the State Government rejected their claim for salary to the post of Assistant Teacher from State exchequer. Nirmal Brahm Higher Secondary School, Maddhupur, Ambedkar Nagar is recognised by the Board of High School and Intermediate Colleges. This institution imparts education upto the level of the Xth standard. The institution was recognised in the year 1981 and it was brought under the grant-in-aid scheme w.e.f. November, 1991. The State Government while giving grant-in-aid, sanctioned only one post of Head Master, six posts of Assistant Teachers of C.T. Grade, one post of Clerk and two posts of Class-IV employees. It is said that the strength of the institution at that point of time was 1085 students. Between 1981-1991 several additional sections from Class-VI to Class-X were sanctioned and at the time of filing of the petition, there were 33 sections in the institution.
(3.) The petitioners' case was that they had been appointed following the procedure and their appointments were approved by the District Inspector of Schools. It was further said that on 12.1.1995, the District Inspector of Schools, Faizabad (Now Ayodhya Ji) sent a detailed report to the Deputy Director of Education, IXth Region, Faizabad giving the details of infrastructure, strength of students, name of teachers, who were working in the institution, their qualifications, respective date of appointment and the dates of approval. It was said that in the aforesaid report dated 12.1.1995 sent by the District Inspector of Schools, it was recommended that the institution has sent a requisition to the U.P. Secondary Education Selection Board for 17 posts of Assistant Teachers and one post of Head Master. It was further said that the Additional Director of Education recommended for sanctioning salary of 17 posts of Assistant Teachers, 21 L.T. Grade Teachers, one post of Clerk and 10 posts of Class-IV employees including a Daftari.;
