- (1.) Heard Sri Rakesh Kumar Chaudhary, learned Counsel for the applicants/appellants and Sri V. K. Dubey, learned Counsel for the respondent on the application for condonation of delay [C.M. Application No.76828 of 2019] as also on the merits of appeal.
(2.) The appeal filed by the department is beyond time by 56 days.
(3.) Considering the averments made in the affidavit filed in support of an application for condonation of delay, we allow the application and condone the delay.;
