JUDGEMENT
SAURABH SHYAM SHAMSHERY,J. -
(1.) Heard Shri. Sanjay Kumar Srivastava, holding brief of Shri.Mohd. Naushad Siddiqui on behalf of the petitioner and the learned Standing Counsel.
(2.) This writ petition has been filed seeking following reliefs:
"(a) issue a writ, order or direction in the nature of certiorari quashing the impugned order dt:8.11.2005 passed by respondent no.1 (Annexure "8" to the writ petition)
(b) issue a writ, order or direction in the nature of mandamus commanding and directing the respondents to appoint the petitioner under Dying-in-Harness Rules on the post of Class IV employee in the office of respondent no.4.
(c) issue a writ, order or direction in the nature of mandamus commanding the respondents no.1 and 2 to issue an appointment letter or approval for appointment of the petitioner on Class IV employee under the Dying-in-Harness Rules.
(d) issue any other writ, order or direction which the Hon'ble Court may deem fit and proper in the circumstances of the present case.
(e) Award costs to the petitioner from the contesting respondents."
Undisputed facts of the present case are as follows:
(3.) That the grand father of the petitioner namely Dwarika Prasad died on 17.11.2002 while in service. Petitioner's father had earlier died on 22.2.1998. Under these circumstances, the petitioner applied for services under the Dying-in-Harness Rules on 16.1.2003 being the grand son. However, when his application was not considered, the petitioner approached this Court by way of filing Writ Petition No.56917 of 2005 which was disposed of vide order dated 23.8.2005 with the following observations:
"In the facts and circumstances of the case, writ petition is disposed of with a direction upon respondent no.1 to consider the application of the petitioner for compassionate appointment strictly in accordance with law preferably within six weeks from the date a certified copy of this order is filed before the respondent no.1. Respondent no.1 shall pass a reasoned speaking order." ;
