JUDGEMENT

Devendra Kumar Upadhyaya, j. - (1.) Since the subject matter of these two writ petitions are intertwined, the same are being decided by following common judgment and order. Writ Petition No. 8074 (Consolidation) of 1988 was originally filed by one Ram Anuj Singh. The petition was, however, dismissed as having been rendered infructuous vide Court's order dated 05.12.2013. While dismissing the writ petition, this Court in its order dated 05.12.2013 had also provided that in case any restoration application is filed, the writ petition will be restored.
(2.) On a restoration application, the petition was restored by the Court on 29.01.2014. In the meantime, the sole petitioner-Ram Anuj Singh died and accordingly an application was moved by one Chhotey Lal Singh, who is already impleaded as respondent no.3 in the writ petition, for transposition of his name in place of deceased petitioner Ram Anuj Singh on the ground that he is only the legal heir and representative of deceased Ram Anuj Singh. The said application moved by Chhotey Lal Singh for transposition as petitioner was allowed by the Court vide its order dated 11.08.2017.

The petition was, however, heard on merit after transposition of Chhotey Lal Singh in place of deceased Ram Anuj Singh as petitioner and was dismissed by the Court vide its order dated 11.08.2017. After dismissal of the writ petition on 11.08.2017, an application was moved by four individuals, namely, Ashok Kumar Singh, Vijay Kumar Singh, Rajesh Kumar Singh and Deep Naraian Singh seeking their impleadment and recall of the order dated 11.08.2017. Vide order dated 31.05.2019 these persons have been ordered to be impleaded as petitioners and the order dated 11.08.2017 was recalled by the Court on 29.04.2019. ;
