The present writ petition has been filed challenging the order dated 29.7.2017 passed by the Deputy Director of Consolidation, by which restoration/recall application filed by respondent no. 5 and 6 has been allowed and revision no. 486 has been restored to its original number and directed to be finally decided on merits.
(3.) Heard Sri Subodh Kumar and Sri Shahid Ali Siddiqui, counsel for the petitioner and Sri Vijay Kumar Rai appearing on behalf of respondent no. 5 and 6. Briefly stated the facts giving rise to this petition are that against the proposed scheme for allotment of chak by the Assistant Consolidation Officer, the petitioner filed his objection which was rejected vide order dated 25.3.2015. Challenging the said order dated 25.3.2015, the petitioner preferred an appeal which too was dismissed by the Settlement Officer Consolidation vide order dated 8.6.2015. Thereafter, the petitioner preferred Revision No. 486 on 8.6.2015 challenging the order dated 8.6.2015 of the Settlement Officer Consolidation and order dated 25.3.2015 of the Assistant Officer Consolidation. The revision filed by the petitioner was allowed by the Deputy Director of Consolidation vide order dated 18.6.2015. Against the said order, the respondent no. 5 & 6 moved an application for recalling the order on the ground that they were never heard in the revision and the revision was decided within ten days from the date of its filing. It was further averred in the recall application that no notice was ever served on them and even they never engaged any counsel on their behalf. The Deputy Director of Consolidation by the order impugned dated 29.7.2017 allowed the application, recalled the order dated 18.6.2015 and restored the revision to its original number for decision on merits. It is against this order dated 29..7.2017 that the present writ petition has been filed.;
